Avitoholius Terms of Service
Effective date: 18 October 2026
1. Who we are
Avitoholius is provided by AVITOHOLIUS LTD. (АВИТОХОЛИЙ ЕООД), a company registered in Bulgaria, UIC 208601085, VAT number BG208601085, registered address 1 Atanas Dukov Street, floor 6, Lozenets, 1407 Sofia, Bulgaria ("we", "us").
2. About these terms
These terms apply to every business that uses Avitoholius ("the business") and to every person who connects one of the business's accounts to Avitoholius ("you"). By connecting an account, you accept these terms and the Avitoholius Privacy Policy on behalf of the business and confirm that you are authorised to do so. If the business has a separate written agreement with us, that agreement takes priority where it differs from these terms.
3. The service
Avitoholius is a content service for businesses. The business connects its own accounts through each platform's official consent screen, our team prepares videos, images and captions, and a person approves every item in the Avitoholius app before anything is sent to a platform. Approved content then goes to the business's own accounts:
- YouTube: videos are uploaded to the business's channel, set to private by default unless the business decides otherwise.
- Facebook and Instagram: posts are published to the business's Facebook Page and the Instagram professional account linked to it.
- TikTok: videos are sent to the account holder's TikTok inbox as drafts (see Section 8).
For YouTube, Facebook and Instagram we also read basic results of the business's content so we can report them to the business.
4. Connecting accounts
We act on an account only after the account holder has authorised Avitoholius on the platform's own consent screen. We never ask for passwords. The business can withdraw that authorisation at any time (Section 10).
5. The business's responsibilities
The business must:
- own, or be authorised to manage, every account it connects;
- hold all rights and permissions needed for the material it provides, including music, images, trademarks and the consent of people who appear in it (for children, the consent of their parent or guardian);
- make sure that claims, prices and offers it asks us to publish are accurate;
- follow the terms and rules of each platform it uses.
The business permits us to use the material it provides only to prepare and deliver its content.
6. Approval before publication
Nothing is published automatically. Every single item is reviewed and approved by a person in the Avitoholius app before anything is sent to a platform, and it is sent only to the account it was approved for.
7. Platform terms
Each platform's own terms apply alongside these terms:
- YouTube. Avitoholius uses YouTube API Services. By connecting a YouTube channel to Avitoholius, you agree to be bound by the YouTube Terms of Service. We operate Avitoholius in accordance with the YouTube API Services Terms of Service and the YouTube API Services Developer Policies. Google's handling of data is described in the Google Privacy Policy.
- Facebook and Instagram. The Meta Terms of Service and the Instagram Terms of Use apply. Meta's handling of data is described in the Meta Privacy Policy.
- TikTok. If you connect TikTok, you remain bound by the TikTok Terms of Service and the TikTok Privacy Policy.
If a platform removes, restricts or refuses content, or changes or withdraws API access, its decision applies and we cannot override it.
8. TikTok drafts are finished by the account holder
On TikTok, Avitoholius never posts publicly and does not use Direct Post. After approval, the video is sent to the account holder's own TikTok inbox as a draft. To finish it, the account holder opens TikTok → Inbox → taps the notification, edits the video and decides whether to post it. Nothing appears on TikTok until the account holder posts it. The account holder is responsible for the final post, including any settings or disclosures TikTok asks for at that stage.
9. Acceptable use
Businesses may not use Avitoholius to get around a platform's limits or protections, or to publish content that breaks the law or a platform's rules. We may refuse to prepare or send content that would do any of these.
10. Revocation and termination
- The business can revoke our access to any account at any time, in the platform's settings or by e-mailing us. The steps for each platform are in our Privacy Policy. Within 7 days after revocation we delete the tokens and all data obtained through that connection.
- The business can end the service at any time by e-mailing us.
- We may suspend or end the service, by notice sent by e-mail, if the business breaches these terms or a platform's rules, or if a platform withdraws or restricts our access.
- When the service ends, we stop sending content and delete account access and data as described in the Privacy Policy. Content already published stays on the business's accounts, under the business's control. Rights and obligations that arose before the end are not affected.
11. Availability and results
Platforms change their interfaces, set limits and sometimes reject or restrict content for reasons outside our control. We do not guarantee uninterrupted publishing, a particular reach or any specific commercial result.
12. Liability
- We are not liable for loss caused by a platform's decisions, outages or changes, or by material or instructions provided by the business.
- Except in cases of intent or gross negligence, our total liability arising from Avitoholius is limited to the fees the business paid us for the service in the three months before the event giving rise to the claim, and we are not liable for lost profit or other indirect loss.
- The business is liable for third-party claims arising from material it provided without the necessary rights or permissions.
- Nothing in these terms limits or excludes liability that cannot be limited under Bulgarian law, including liability for intent or gross negligence.
13. Privacy
How we handle personal data is described in the Avitoholius Privacy Policy.
14. Changes to these terms
If we change these terms, we will update the effective date above and tell affected businesses directly before the change takes effect.
15. Governing law and disputes
These terms are governed by the law of the Republic of Bulgaria. We will first try to resolve any dispute by discussion. If that fails, the dispute will be decided by the competent Bulgarian courts.
